Wills

 

EVERYONE CAN LEAVE THE WORLD A BETTER PLACE

 

Naturally, the interest of close relatives and friends will come first when you are making a Will, but many people leave the residue (or part of the residue) of their estate to a charity. This is called a residuary bequest.  With one pound going ten times as far when providing care in Romania your legacy could help patients for many years to come.

 

By making a bequest in this way, your gift will keep pace with inflation and will be just as valuable in years to come as it is the day you make your Will. 

 

HOW DO I CHANGE MY WILL?  

If you have changed your mind fundamentally about who benefits from your Will, or if your estate changes a great deal in value, you may be best advised to make an entirely new Will. We usually suggest that you ask a Solicitor to draft your Will, especially if it is complicated. 

If you are only making minor changes, you can add a short instruction known as a Codicil, to your existing Will. This is a good way of adding new legacies for a number of different causes if you wish.

 

 

Writing a Will

 

Here is the suggested wording for a residuary bequest should you wish support Hospices of Hope:

 

"I give, to Hospices of Hope, 28a High Street, Otford, Kent TN14 5PQ (Registered Charity 1088475) (   enter the word "all" or the size of the share   ) of the residue of my estate for its general charitable purposes, and I further direct that the receipt of the Executive Director or other proper officer of the said charity shall be a good discharge for the same".

 

If you prefer you can leave Hospices of Hope a set sum of money or a specific gift. This is called a pecuniary legacy/specific legacy.

 

"I give and bequeath to Hospices of Hope Limited, 28a High Street, Otford, Kent TN14 5PQ (Registered Charity 1088475) free of all tax, the sum of £ (    amount in words and figures) / (or give a description of the specific gift in place of "the sum of "   ) for its general charitable purposes, and I further direct that the receipt of the Executive Director or other proper officer of the said charity shall be a good discharge for the said legacy".

 

Writing a Codicil

Below is some suggested wording for a Codicil to add a legacy for the Hospices of Hope to your existing Will.

 

I [     full name     ] of [     address     ] DECLARE  this to be a [    first/second/etc   ] Codicil to my Will dated [   insert date of Will  ]:

 

1. In addition to any legacies given by me in my said Will I give to Hospices of Hope, 28a High Street, Otford, Kent TN14 5PQ (registered charity 1088475) free of all tax, the sum of £ (    amount in words and figures) / (or give a description of the specific gift in place of "the sum of "   ) for its general charitable purposes, and I further direct that the receipt of the Executive Director or other proper officer of the said charity shall be a good discharge for the said legacy. 

 

Additional wording may be added to the legacy or codicil examples above to cover the possibility of a name change, merger or transfer of assets to another body.

 

If before my death (or even after my death, but before my executors have given effect to the gift) Hospices of Hope has changed its name or amalgamated with any other body or transferred all its assets to any other body then my executors shall give effect to the gift as if it were a gift to the body in its changed name or to the body which results from the amalgamation or to the body which the assets have been transferred.

 

 

Have Your Will Witnessed.

 

When you are happy with your Will or Codicil, it will need to be properly signed by you and witnessed. Two independent witnesses are needed, and they and their spouses must be people who have nothing to gain from the Will. All must be present together and sign in each other's presence. A solicitor will ensure that the Will is correctly witnessed.

Here is a form of words suitable for a Codicil to an existing Will.

In all other respects I confirm my said Will and any other Codicils thereto.

IN WITNESS whereof I have hereunto set my hand this [  insert day, month and year  ] .
Signed by the said
[    insert your full name     ] as a Codicil to [  his/her ] last Will in the presence of us who at [  his/her  ] request and in the presence of each other have hereunto subscribed our names as witnesses [       insert the signature, name and address of two witnesses        ].
